1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Adama Platform Engineering, LLC, a Kansas limited liability company ("Company," "we," "us," or "our"), governing your access to and use of the OpinionPanel.AI website, application, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

OpinionPanel.AI is an AI-powered health research and information tool. The Service assembles multiple AI research perspectives to analyze health information you provide and generates structured, cited research summaries intended to help you prepare for conversations with your healthcare provider.

3. NOT Medical Advice — Critical Disclaimer

THE SERVICE DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. THE SERVICE IS FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY.

  • The Service is not a substitute for professional medical advice, diagnosis, or treatment.
  • The AI-generated content does not constitute a medical opinion, second opinion, or clinical recommendation.
  • The AI researchers are not doctors, physicians, or licensed healthcare professionals.
  • You should never disregard professional medical advice, delay seeking medical treatment, or discontinue medical treatment based on information provided by the Service.
  • Always consult a qualified healthcare provider before making any health-related decisions.
  • If you are experiencing a medical emergency, call 911 or your local emergency services immediately.

The research reports generated by the Service are designed to help you have more informed conversations with your healthcare provider. They are not a replacement for the clinical judgment of a licensed medical professional who has examined you.

4. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

5. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You agree to provide accurate and complete information when creating your account.
  • You must notify us immediately of any unauthorized use of your account.

6. Health Information You Provide

You acknowledge and agree that:

  • Any health information you provide is submitted voluntarily for the purpose of receiving research reports.
  • You are responsible for the accuracy of the information you provide. Inaccurate or incomplete information may result in less relevant research findings.
  • The health information you provide will be shared with third-party AI providers (currently Anthropic/Claude, xAI/Grok, and OpenAI) solely for the purpose of generating your research report. See our Privacy Policy for details.
  • You should not submit information about third parties without their consent, except when using the Service as a caregiver or authorized family member.

7. Payment and Refunds

  • Certain features of the Service require payment. Current pricing is displayed on the Service and may be updated from time to time.
  • All payments are processed by third-party payment processors. By making a payment, you agree to the payment processor's terms.
  • Payments for research reports are due at the time of purchase.
  • Because the Service delivers digital content that is generated and delivered immediately, all sales are final once a research report has been generated. However, if you experience a technical issue that prevents delivery of your report, contact us at support@opinionpanel.ai and we will resolve the issue or provide a refund.
  • Subscription plans (Annual, Family) may be canceled at any time. Cancellation takes effect at the end of the current billing period. No prorated refunds are provided for partial billing periods.

8. Intellectual Property

  • The Service, including its design, text, graphics, logos, and software, is owned by Adama Platform Engineering, LLC and is protected by copyright, trademark, and other intellectual property laws.
  • Your research reports are generated for your personal use. You may print, share with your healthcare providers, and use them for your own health management purposes.
  • You may not resell, redistribute, or commercially exploit the Service or its outputs without our prior written consent.

9. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose
  • Misrepresent the outputs of the Service as professional medical advice or clinical recommendations
  • Attempt to reverse-engineer, decompile, or extract the underlying algorithms or models
  • Use automated means (bots, scrapers) to access the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Resell access to the Service or its outputs
  • Submit intentionally false health information to manipulate outputs

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, Adama Platform Engineering, LLC disclaims all warranties, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Any warranty that the Service will be uninterrupted, error-free, secure, or free of viruses
  • Any warranty regarding the accuracy, completeness, reliability, or currentness of the AI-generated research content
  • Any warranty that the research outputs will be suitable for any medical purpose or clinical decision-making

AI-generated content may contain errors, omissions, or outdated information. The citations referenced in research reports should be independently verified. The research reports reflect AI analysis at the time of generation and may not reflect the most current medical research.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ADAMA PLATFORM ENGINEERING, LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Damages arising from any health decisions made based on the Service's outputs
  • Loss of data, revenue, profits, or business opportunities
  • Personal injury or property damage related to your use of the Service
  • Any damages arising from unauthorized access to or alteration of your data

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Adama Platform Engineering, LLC, its officers, directors, members, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Any health decisions you make based on the Service's outputs

13. Third-Party AI Providers

The Service uses third-party AI providers (Anthropic/Claude, xAI/Grok, and OpenAI) to generate research content. You acknowledge that:

  • We do not control the AI models or their outputs
  • AI-generated content may occasionally be inaccurate, incomplete, or inconsistent
  • The specific AI providers used may change over time
  • We are not liable for the acts or omissions of third-party AI providers

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Kansas. You agree to waive your right to a jury trial and to participate in a class action lawsuit or class-wide arbitration.

15. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 3, 10, 11, 12, and 14.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Adama Platform Engineering, LLC regarding your use of the Service and supersede all prior agreements and understandings.
